Welcome to Kazutaka Budō Kōbō / Shogun Kendogu (“we”, “our”, “us”). By using our website, placing an order, or interacting with any part of our online store, you agree to the following Terms and Conditions. Please read them carefully before purchasing. If you do not agree with these terms, please do not use this website or our services.

1. Company Information

Kazutaka Budō Kōbō is a Japanese company that designs, manufactures, and sells kendo equipment worldwide. Shogun Kendogu is our global trading name.
All contracts, transactions, and communications are governed by these Terms and Conditions.

2. Copyright and Trademarks

All content on this website – including text, graphics, images, photographs, and code – is the property of Kazutaka Budō Kōbō / Shogun Kendogu and is protected under Japanese and international copyright law. You may electronically copy or print portions of this website only for personal use in placing an order. Any other use, reproduction, or redistribution without written permission is strictly prohibited. All trademarks, service marks, and trade names used on this site are owned or licensed by Kazutaka Budō Kōbō.

3. Use of Website

You agree not to use this website in any way that is unlawful, defamatory, obscene, abusive, or infringes on the rights of others. Impersonating our staff, uploading harmful material, or attempting to disrupt our site is strictly prohibited. We reserve the right to refuse service or terminate access to anyone who breaches these terms.

4. Product Representation

We take great care to display our products as accurately as possible. However, colour variations may occur due to monitor settings, natural materials, and production differences. Custom designs shown through our Bōgu Builder or shared images are representative only and may differ slightly from the final product.

5. Orders and Payments

All orders are considered final once payment is received. Because most of our equipment is custom-made, cancellation requests will only be considered before production begins and are at our sole discretion. Approved cancellations are subject to a 15% restocking and administration fee. Prices are listed in USD unless otherwise stated. We reserve the right to refuse or cancel any order due to pricing or typographical errors.

6. Shipping and Customs

We ship worldwide from Japan and reserve the right to choose the shipping method for orders eligible for free shipping.

Once a parcel has left Japan, we are not responsible for:

• delays caused by customs or couriers,

• import duties, taxes, or handling fees charged by your country,

• loss, theft, or damage in transit.

If a parcel is returned because of incorrect address details or refusal to accept delivery, the customer will be charged for all return shipping and any reshipment fees.

7. Limited Warranty and Defective Goods

We stand behind the quality of our products and provide a limited warranty against manufacturing defects.

If you believe your product is defective:

1. Contact us at info@shogunkendogu.com within 14 days of delivery.

2. Include clear digital photos showing the defect.

3. We will assess the claim and advise on the next steps.

If the product is confirmed defective:

• You may return it (unused, unwashed, in original packaging).

• We will repair, replace, or refund the product at our discretion.

• If approved, we will cover the cost of return shipping.

What is not covered:

• Normal wear and tear

• Misuse, neglect, or improper maintenance

• Damage from impact, accidents, or alteration

• Colour or material variations due to natural fabrics

Our liability under this warranty is strictly limited to the original purchase price of the product.

8. Returns and Exchanges

We only accept returns if all of the following conditions are met:

• The product is in original condition

• Unused and unwashed

• Free of lint, hair, or dirt

• In original packaging

All claims for returns or exchanges must be made within 14 days of delivery. We record and photograph all outgoing orders to verify claims. If the return is accepted, the customer is responsible for shipping costs unless we are at fault.

9. Incorrect Size or Wrong Product

If the wrong size or product is received:

• Send photos showing the discrepancy.

• We will determine who was at fault.

If we made the error, we will cover all return and replacement costs. If you provided incorrect measurements or selected the wrong size, we may decline an exchange or charge full return shipping costs. Please double-check your measurements carefully before ordering. You are welcome to send us photos to confirm sizing before placing your order.

10. Cancellations

All products are made to order and considered custom goods. Once production begins, cancellations are not accepted. If a cancellation is approved before production, a 15% restocking fee applies. Partial refunds may be offered at our discretion depending on the level of customisation and production stage.

11. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages, including loss of profits or data.

• Our total liability is limited to the amount paid for the product in question.

You agree that you will not hold Kazutaka Budō Kōbō / Shogun Kendogu, its owners, staff, or suppliers liable for any claim arising from the use or misuse of our products or website.

11a. Assumption of Risk and Equipment Use Disclaimer

Kendo and related martial arts are physical contact activities that involve inherent risk of injury. By purchasing, using, or wearing equipment from Kazutaka Budō Kōbō / Shogun Kendogu, you acknowledge and accept that no equipment can fully prevent injury or death during training or competition.

You agree that:

• You are voluntarily participating in these activities at your own risk.

• You understand that correct usage, maintenance, and inspection of equipment are your responsibility.

• Kazutaka Budō Kōbō / Shogun Kendogu shall not be held liable for any injury, accident, or damage arising from use or misuse of its products, including normal wear, improper fit, modification, or failure to follow training or safety guidelines.

All equipment must be inspected regularly for damage or wear and replaced when necessary. Use of our products constitutes acceptance of this risk and waiver of any claims against Kazutaka Budō Kōbō / Shogun Kendogu, its staff, or affiliates.

12. Force Majeure

We are not responsible for delays or failures caused by circumstances beyond our control, including but not limited to natural disasters, strikes, shipping disruptions, pandemics, government actions, or system failures.

13. Privacy and Use of Customer Content

We value your privacy. Personal information (such as names, addresses, or payment details) will never be shared or sold. From time to time, we may feature images of custom designs, bogu, or embroidery work created through our service. These may be shared online for promotional or educational purposes without disclosing any personal customer information. If you wish to opt out of having your custom design displayed, please contact us at info@shogunkendogu.com.

14. Third-Party Links

Our website may include links to third-party sites. These are provided for convenience only. We are not responsible for the content or privacy practices of those sites.

15. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Japan. Any disputes shall be resolved exclusively in the courts of Japan. In the event of any translation discrepancies, the English version of these Terms and Conditions shall prevail.

16. Termination

We reserve the right to terminate or suspend access to our website or services at any time, without notice, for any reason, including breach of these Terms.
